Toy product liability: check age ranges, product types and exclusions

A product description comes before a policy comparison

For a children's product seller, the intended user is part of the product description. A soft toy, an activity set and a battery-operated toy need more precise information than a single toys category selection.

Use the questions below to discuss proposed policy wording with an insurer. They identify points to clarify; they do not describe guaranteed Assureful coverage or imply that every product in this guide can be insured.

Three questions for your insurer

  • Are the intended age ranges clear?

    Give the insurer the labelled age range and intended use for each line. Ask whether the proposed terms distinguish between product types or users and whether any toys are excluded.

  • Does the review include every component?

    Describe small parts, magnets, batteries, accessories and other components where present. Ask how the complete product or kit is treated, rather than assuming the main item's description covers the whole set.

  • How do testing documents relate to coverage?

    Ask what product documentation the insurer needs and how any policy conditions apply. Testing or listing acceptance does not, by itself, mean an insurance policy has been issued or that all claims are covered.

When the product range changes

A seller of fabric toys adds an electronic activity set. The new product introduces a different component list and intended use. Review its classification and insurance scope even if the brand's monthly revenue has not changed.

This is an illustrative situation, not a claim example or an eligibility decision. Keep a written record of what you disclosed and the insurer's response, especially where a new product or activity needs further review.

Read beyond the headline limit

For affected categories, Amazon's November update specifies at least $1 million per occurrence and in the aggregate. The occurrence limit applies to a covered occurrence; the aggregate limits covered claims over the applicable period, subject to the policy wording. A certificate showing those figures does not explain all exclusions, deductibles or conditions.

Ask about the insured business name, products, activities, policy period and applicable territory. Review the full terms and Amazon's current proof requirements before relying on a quote or certificate.

Common questions

Does a $1 million certificate prove every product is covered?

No. The policy's product scope, exclusions, conditions and other terms matter. Ask the insurer to review the actual range; a certificate summarises certain policy information and does not replace the full wording.

Can I apply with less than $10,000 in monthly sales?

Yes. Assureful's application accepts sales figures below $10,000 a month. Use your actual sales or a reasonable projection. An estimate does not guarantee product eligibility, an issued policy or Amazon's acceptance of your documents.
